1. Acceptance of These Terms
Welcome to InD'tale Magazine. These Terms and Conditions ("Terms") govern your access to and use of the website www.indtale.com and all related services, content, and features (collectively, the "Site") operated by InD'tale Magazine ("we," "us," or "our").
By accessing or using the Site, creating an account, subscribing, submitting content, or otherwise interacting with us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Site.
We may update these Terms from time to time. The "Effective Date" at the top of this page indicates when the current version took effect. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
2. Description of the Service
InD'tale Magazine is an online magazine focused on independent (indie) authors, book reviews, writing-related content, industry news, and related community features. We offer free and/or paid access to digital magazine issues, articles, reviews, and other content. Certain features, including full access to issues or special content, may require a paid subscription.
We reserve the right to modify, suspend, or discontinue any part of the Site or services at any time, with or without notice.
3. Eligibility
You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account, subscribe, or use certain features of the Site. By using the Site, you represent that you meet this requirement and have the legal capacity to enter into these Terms. The Site is not directed to children under 13.
4. Accounts and Registration
Some features of the Site may require you to create an account. When you register, you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to notify us immediately at support@indtale.com if you become aware of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
5. Subscriptions, Payments, and Cancellations
5.1 Paid Subscriptions
Certain content and features are available only to paying subscribers. By purchasing a subscription, you agree to pay the applicable fees and any applicable taxes. Subscription prices and terms will be clearly displayed at the time of purchase.
5.2 Billing and Auto-Renewal
Subscriptions may automatically renew at the end of each billing period unless you cancel before the renewal date. By purchasing a recurring subscription, you authorize us (or our payment processor) to charge your chosen payment method on a recurring basis until you cancel.
5.3 Cancellation
You may cancel your subscription at any time by following the instructions in your account settings or by contacting us at support@indtale.com. Cancellation will take effect at the end of the current paid billing period. You will continue to have access until the end of that period.
5.4 Refunds
Because our content is digital and delivered immediately or on a recurring basis, all sales are generally final. We do not provide refunds or credits for partial subscription periods, unused access, or dissatisfaction after content has been made available, except where required by applicable law. If you believe you are entitled to a refund under special circumstances, please contact support@indtale.com.
5.5 Price Changes
We may change subscription prices from time to time. Price changes for existing subscriptions will be communicated in advance and will apply to subsequent renewal periods.
6. User Content and Submissions
The Site may allow you to submit, post, or upload content such as comments, reviews, author information, book details, messages, or other materials ("User Content"). You retain ownership of your User Content, but by submitting it you grant InD'tale Magazine a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that User Content in connection with operating and promoting the Site and our services.
You represent and warrant that:
You own or have the necessary rights to the User Content you submit;
Your User Content does not infringe any third-party rights (including copyright, trademark, privacy, or publicity rights);
Your User Content is accurate and not misleading; and
Your User Content does not violate these Terms or any applicable law.
We reserve the right (but have no obligation) to review, edit, refuse, or remove any User Content at our sole discretion.
7. Intellectual Property Rights
All content on the Site (excluding User Content), including text, graphics, logos, images, digital magazine issues, reviews, articles, design, and software, is the property of InD'tale Magazine or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the content for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, republish, download (except for personal offline reading of authorized digital issues), or exploit any content without our prior written permission.
The InD'tale Magazine name, logo, and related marks are our trademarks. You may not use them without our prior written consent.
8. Prohibited Conduct
You agree not to:
Use the Site for any unlawful purpose or in violation of these Terms;
Post or transmit any content that is defamatory, obscene, harassing, hateful, threatening, or otherwise objectionable;
Impersonate any person or entity or misrepresent your affiliation;
Interfere with or disrupt the Site, servers, or networks;
Attempt to gain unauthorized access to any portion of the Site or any related systems;
Use any automated means (bots, scrapers, spiders, etc.) to access or collect data from the Site without our express written permission;
Reproduce, redistribute, or commercially exploit magazine content or reviews beyond personal use;
Violate any applicable local, state, national, or international law.
9. Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Book reviews, ratings, and opinions expressed on the Site are those of the individual reviewers or authors and do not necessarily reflect the views of InD'tale Magazine. We make no guarantees regarding the accuracy, completeness, or usefulness of any content.
Any reliance you place on content found on the Site is strictly at your own risk.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IN'D'TALE MAGAZINE, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US $100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless InD'tale Magazine and its owners, officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.
12. Termination
We may suspend or terminate your access to the Site, your account, or your subscription at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Site will immediately cease. Provisions of these Terms that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and indemnification) will survive.
13. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Site shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Nevada, and you hereby consent to the personal jurisdiction and venue of such courts.
Before filing any formal legal action, you agree to first contact us at support@indtale.com and attempt to resolve the dispute informally in good faith.
14. Copyright Complaints (DMCA)
If you believe that content on the Site infringes your copyright, you may send a notice of claimed infringement to us at support@indtale.com. Please include: (a) a description of the copyrighted work; (b) the location of the allegedly infringing material on the Site; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and (f) your physical or electronic signature.
We will respond to valid notices in accordance with the Digital Millennium Copyright Act (DMCA) or other applicable law.
15. Miscellaneous
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and InD'tale Magazine regarding the Site and supersede any prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
Headings: Section headings are for convenience only and have no legal effect.
